Fulton County Jury Awards $494,556 Against City of South Fulton in Personal Injury Case

A Fulton County jury has returned a verdict of $494,556.29 against the City of South Fulton in a personal injury case, a result that underscores the challenges of pursuing claims against governmental entities in Georgia. The verdict, returned on May 19, 2026, and finalized by Judge Robert Wolf of the State Court of Fulton County the following day, was more than double the amount offered during court-ordered mediation. The jury awarded $144,556.29 for medical expenses and $350,000 for pain and suffering to client Cherise Mitchell-Weathers. The case was filed as Civil Action No. 25EV001453.

The outcome is significant because personal injury claims against Georgia cities are governed by a unique set of rules that can trip up even experienced attorneys. Under O.C.G.A. § 36-33-5, anyone seeking money damages from a municipality must serve written ante litem notice on the city within six months of the incident. Missing that deadline or providing improper notice can bar the claim entirely, even if the two-year statute of limitations for most injury cases has not expired. Additionally, Georgia law limits when a city waives its sovereign immunity, creating additional defenses that can complicate litigation.

Jason Schneider, co-founder and managing partner at Schneider Williamson, the Atlanta personal injury firm representing the plaintiff, explained the difficulty. "Suing a city is a different animal with many potential pitfalls," said Jason Schneider. "There are notice deadlines that can end a case before it starts. There are immunity defenses at every turn. And you're dealing with a defendant that has no real reason to settle as its liability is limited by law. You have to be ready to put it in front of twelve people and let them decide."

The verdict reflects the firm's approach of preparing every case for trial from the outset. The team at Schneider Williamson handles personal injury matters including car and truck wrecks, premises liability, catastrophic injuries, and wrongful death. According to the firm, a defendant pays fair value only when it believes the case will actually be tried. The firm's case results page lists additional successful outcomes.

For individuals injured by a city or other public entity, the verdict offers a measure of hope. While the procedural hurdles are real, they are not insurmountable. A claim that clears them is entitled to the same full measure of damages as any other claim. The key, according to the firm, is acting quickly in the first few weeks to locate witnesses, hire experts, inspect the scene and vehicles, and serve the proper notice well within the deadline.
